These Terms of Service ("Terms") govern your access to and use of SundayBack ("SundayBack," "we," "us," "our"), a software-as-a-service platform operated at sundayback.app. Please read them carefully. They define what SundayBack does, what you agree to do, and how risk is allocated between us.
If you do not agree to these Terms, do not access or use SundayBack.
By creating an account, purchasing a subscription, reserving a place, accessing, or using SundayBack in any way, including via the web application, an API, or any agent output produced by SundayBack, you agree to these Terms.
You must be at least 18 years old and have the legal capacity to enter into a binding contract. If you are accepting these Terms on behalf of an entity, you represent that you have authority to bind that entity, and "you" refers to that entity.
These Terms supersede all prior agreements between you and SundayBack on this subject matter, except for an executed written agreement that expressly modifies them.
SundayBack is a software tool. It is not a fiduciary, advisor, agent, or representative of any kind. It is not a law firm, accounting firm, medical practice, financial advisor, or licensed professional service.
SundayBack produces drafts, suggestions, summaries, analyses, and other content using artificial intelligence ("agent outputs"). Agent outputs are generated by automated systems (large language models, retrieval components, and tool-use orchestration) and are intended as a starting point for your own work, not as a finished product.
References on this site and in the product to a "CMO," to "specialists," to "a department," or to any similar named role describe software functions, not human employees or contractors. No human being is assigned to your account to perform this work.
SundayBack is the tool. You are the operator. The decision to use, send, publish, rely on, or act on any agent output is yours alone.
This section is the core of how risk is allocated between you and SundayBack.
Agent outputs are AI-generated and may be inaccurate, incomplete, or out of date. You will review every output SundayBack produces before:
This obligation is contractual. It is the central commitment you make when you accept these Terms.
Any agent output you choose to send, publish, or otherwise transmit to a third party is your speech, not SundayBack's speech. You bear publisher liability for it, including under defamation law, intellectual property law, advertising and consumer protection law (including the Federal Trade Commission Act § 5, 15 U.S.C. § 45, and state UDAP statutes), the CAN-SPAM Act of 2003 for email, the Telephone Consumer Protection Act for SMS, and the terms of any platform you publish to.
You will comply with all applicable laws and regulations in your use of SundayBack, including Section 11 (Restricted Use Categories) and Section 12 (Acceptable Use).
You will provide accurate, current, and complete information when you sign up and when you input data. You are responsible for the confidentiality of your account credentials and for all activity under your account.
SundayBack makes no warranty, express or implied, regarding the accuracy, completeness, currency, fitness for a particular purpose, or non-infringement of any agent output.
Agent outputs are generated by AI models that can hallucinate (produce fabricated facts), reproduce biases present in training data, fail to incorporate recent information, or otherwise produce content that is factually wrong or contextually inappropriate. You acknowledge these limitations when you accept these Terms.
The active-review obligation in Section 3.1 exists because AI outputs require human verification before reliance.
You retain ownership of all content you input into SundayBack ("user inputs") and all agent outputs SundayBack generates from your use ("agent outputs"). Together, "your content."
By choosing to send, publish, or transmit any of your content to any third party, you become the publisher of that content. As publisher you are solely responsible for its legality under all applicable laws, including:
SundayBack is the tool that helped you draft the content. You are the publisher who chose to send it.
SundayBack will defend, indemnify, and hold you harmless from third-party claims arising from SundayBack's gross negligence or willful misconduct in operating the service. This is subject to the liability cap in Section 15, your prompt notice of the claim, your reasonable cooperation in the defense, and SundayBack's exclusive control of the defense and any settlement.
SundayBack does not indemnify you for claims arising from:
SundayBack does not warrant the accuracy, completeness, or non-infringement of agent outputs. Indemnification does not substitute for review.
You will defend, indemnify, and hold SundayBack harmless from any third-party claim, demand, action, loss, damage, cost, or expense (including reasonable attorneys' fees) arising from:
This indemnification survives termination of these Terms.
You own all copyright in your inputs and in the agent outputs SundayBack generates from your use. SundayBack claims no ownership in your content.
You grant SundayBack a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, display, and create derivative works of your content solely as necessary to operate the service, provide it to you, support your use, and maintain the operational reliability of the service. This licence does not extend to using your content to train SundayBack's underlying AI models. See Section 9.
The licence terminates automatically when you delete the content from SundayBack or close your account, except for backup copies retained as documented in the Privacy Policy and any copies already distributed at your direction.
9.1 Personalisation data. SundayBack collects data about how your agents perform on your tasks, your voice patterns, your decision history, and your workspace state. This is used exclusively to make your SundayBack workforce better at serving you. It is not shared across user accounts.
9.2 Aggregate usage analytics. SundayBack collects anonymised, aggregated metrics across all users to improve the product. This does not include your content, your business data, or anything that could identify you or your business.
9.3 What we do not do. We do not use your content to train large language models. We do not sell your data. We do not use your data to train models that serve other users. We do not share your data with our model vendors for their model training; our vendor agreements bar that use.
9.4 Your choices. There is currently no setting that turns off 9.1 or 9.2 for your account, and we do not currently offer an opt-out from either. 9.1 runs for every account. We are building a control that will let you switch 9.1 off; when it is available, this section will say so. Your rights over your personal data, and how to use them, are set out in our Privacy Policy.
9.5 Future changes. If SundayBack ever expands the scope of data use, for example to include cross-user learning or model training on user content, we will give at least 60 days' advance written notice to all active accounts, require affirmative opt-in consent from any user whose data would be included, and record the change in the change log of our Privacy Policy at www.sundayback.app/privacy.
You acknowledge that agent outputs may be inaccurate, incomplete, fabricated, biased, or out of date; that this is a known property of large language models and not a defect in SundayBack's service; and that the active-review obligation in Section 3.1 exists for that reason.
If you transmit an inaccurate or fabricated agent output to a third party without performing the active review, the consequences of that transmission are yours, not SundayBack's, subject only to SundayBack's obligations under Section 6.
SundayBack's agent outputs may not be used as a substitute for licensed professional advice. You will not use SundayBack to:
11.1 Practise law. Agent outputs do not constitute legal advice. Unauthorised practice of law is a state-by-state offence codified in each state's bar admission and practice statutes. You will not use SundayBack to give legal advice, draft binding contracts on behalf of others, or represent another person in a legal matter without being a licensed attorney admitted in the relevant jurisdiction.
11.2 Give tax advice. Agent outputs do not constitute tax advice. Tax practitioner conduct is regulated by IRS Circular 230 (31 CFR Part 10) and state CPA rules. You will not use SundayBack to give tax advice or prepare tax returns for others without the relevant licence.
11.3 Give medical advice. Agent outputs do not constitute medical advice. State medical practice acts and FDA regulations govern medical advice and medical-device claims. You will not use SundayBack to diagnose, treat, prevent, or cure any medical condition.
11.4 Give investment or financial advice. Agent outputs do not constitute investment or financial advice. Investment-advisory conduct is regulated by the Investment Advisers Act of 1940 (15 U.S.C. § 80b) and state Registered Investment Adviser rules. You will not use SundayBack to give investment advice or recommend specific securities without the relevant registration.
11.5 Process Protected Health Information. SundayBack is not HIPAA-compliant. SundayBack has not executed Business Associate Agreements with the model providers, infrastructure providers, or sub-processors used to deliver the service. You will not input Protected Health Information as defined at 45 CFR § 160.103 into SundayBack. If you do, you indemnify SundayBack under Section 7.
You will not use SundayBack to:
SundayBack may suspend or terminate an account for a violation of this section under Section 14. Changes to this section are made under Section 18, like any other change to these Terms.
12.1 Agencies and others acting for you. You may let an agency, contractor, or employee operate your account on your behalf. Each business needs its own account, and the business the account is for is the account holder under these Terms, whoever pays for it. Anyone who operates your account must follow these Terms, and you are responsible for what they do in it as if you had done it yourself. Charging your own clients for your services, including running their SundayBack account for them, is not reselling SundayBack. Reselling means selling access to SundayBack itself, or serving more than one business from one account.
13.1 Plans and prices. SundayBack is sold as a marketing department at $497 per month, or $4,970 per year. Prices are exclusive of tax; VAT or sales tax is added at checkout where applicable. What is included is described on the pricing page at the time you subscribe.
13.2 Auto-renewal. Your subscription renews automatically at the end of each billing period, monthly for monthly plans and annually for annual plans, at the price stated at checkout, charged to the payment method on file, until you cancel. The renewal price, the renewal interval, and the fact of automatic renewal are disclosed to you clearly and conspicuously before you provide billing information, and you must give affirmative consent to them as a separate step. We send an email confirming those terms after purchase.
13.3 Cancellation. You can cancel at any time and you do not have to speak to anyone. Email [email protected] from the address on your account and say you want to cancel; we action cancellations within one business day of receiving them and confirm in writing. If a renewal charge is taken after we have received your email, we refund it. Cancellation takes effect at the end of the billing period you have already paid for, and you keep access until then. We do not charge a cancellation fee. We are building a one-click cancellation link and a cancel button in your account settings; until they are there, the email above is the only step we will ask you to take.
13.4 Price changes. We will give you at least 30 days' written notice by email before any change to your renewal price takes effect. If you do not accept the new price, cancel before the effective date and you will not be charged it.
13.5 Refunds. If this is your first paid SundayBack subscription, you may ask for a full refund of your first payment within 7 days of the date it was charged. The Refund Policy sets out how to ask, what the guarantee does not cover, and how it applies if you paid before the guarantee changed from 30 days to 7. It forms part of these Terms.
13.6 Statutory disclosures. These billing terms are written to meet the Restore Online Shoppers' Confidence Act (15 U.S.C. §§ 8401–8405), the California Automatic Renewal Law (Cal. Bus. & Prof. Code § 17600 et seq.), New York General Business Law § 527-a, Oregon's automatic renewal disclosure law (ORS § 646A.295), the Illinois Automatic Contract Renewal Act (815 ILCS 601/), and Colorado's automatic renewal statute (C.R.S. § 6-1-732). Where those rules differ, SundayBack applies the disclosure most favourable to you.
13.7 Consumers in the EU and the UK. If you buy as a consumer rather than for the purposes of a trade, business, or profession, you have 14 days to withdraw from the contract under Directive 2011/83/EU and the UK Consumer Contracts Regulations 2013. If you ask us to begin supplying the service during that period, you acknowledge that you lose the right of withdrawal once the service has been fully supplied, and that you will pay for what has been supplied up to the point you withdraw. This is presented to you at checkout as a separate affirmative step.
You may cancel your subscription at any time, by the method set out in Section 13. Cancellation takes effect at the end of your current paid billing period unless local law requires otherwise.
SundayBack may suspend or terminate your account for material breach of these Terms, including breach of Section 11 or Section 12, for non-payment after 30 days' delinquency, or as required by law or court order. We will give reasonable advance notice except where immediate action is needed to prevent harm or to comply with legal process.
On termination, the licence you granted under Section 8 ends, and SundayBack will delete your content per the Privacy Policy retention schedule, subject to retention for billing records, legal hold, and similar documented necessities.
To the maximum extent permitted by law, SundayBack's total liability to you for any claim arising out of or related to these Terms or the service, regardless of the form of action, is limited to the greater of (a) the amount you paid SundayBack in the 12 months preceding the event giving rise to the claim, or (b) $100.
This cap applies in aggregate across all claims, not per claim. It applies to direct damages only; consequential, incidental, special, exemplary, and punitive damages are excluded under Section 16.
To the maximum extent permitted by law, SundayBack is provided "AS IS" and "AS AVAILABLE." SundayBack disclaims all warranties, express or implied, including:
Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions these exclusions apply only to the extent permitted by law. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded.
CONSEQUENTIAL DAMAGES EXCLUSION: To the maximum extent permitted by law, neither party is liable for any indirect, consequential, incidental, special, exemplary, or punitive damages, including lost profits or lost business, arising out of or related to these Terms, even if advised of the possibility of such damages.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles.
Any dispute, claim, or controversy arising out of or related to these Terms or the service that cannot be resolved through good-faith discussions for at least 30 days will be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, seated in Houston, Texas, or in any other forum the parties agree to in writing. The arbitrator's award may be entered as a judgment in any court of competent jurisdiction.
Either party may seek injunctive relief in a court of competent jurisdiction for any actual or threatened infringement of intellectual property rights or breach of confidentiality obligations.
CLASS ACTION WAIVER: To the maximum extent permitted by law, you and SundayBack agree to resolve disputes only on an individual basis, and not as a plaintiff or class member in any class, collective, or representative action.
If you are a consumer resident in the EU or the UK, nothing in this section deprives you of the protection of the mandatory consumer-protection rules of your country of residence, or of your right to bring proceedings in the courts of that country.
SundayBack may update these Terms. Material changes will be communicated to active accounts by email at least 30 days before the effective date (or longer where local law requires) and recorded in the change log at the end of this page with a new version number and a one-paragraph summary of what changed.
Your continued use of SundayBack after the new effective date constitutes acceptance of the updated Terms. If you do not accept them, you may cancel before the effective date for a pro-rata refund of any prepaid period not yet used.
Non-material changes, such as typographical fixes, formatting, and clarifications that do not change rights or obligations, do not require advance notice but will still update the date stamp and be recorded in the change log at the end of this page.
SundayBack is operated by Storm Digital Holdings LLC Series B - Sunday Back, a protected series of a Texas series limited liability company.
Notices to you will be sent to the email address on file for your account.
Version 1.3 (2026-10-05). Section 9.5 now says a change in how we use data is recorded in the change log of our Privacy Policy at www.sundayback.app/privacy, and Section 18 now says changes to these Terms are recorded in the change log on this page. Both sections previously pointed to a public changelog that was never published. Section 18 no longer says a new effective date is stamped at the top of this page, and Section 12 now says changes to it are made under Section 18 in place of promising a new effective date of its own.
Version 1.2 (2026-10-04). Section 12 clarifies reselling and adds 12.1: agencies and others may operate an account on a business's behalf.
Version 1.1 (2026-09-27). Section 13.5 (Refunds) updated to the 7-day money-back guarantee set out in Refund Policy version 1.1. Section 13.3 (Cancellation) now names cancelling by email to [email protected], and Section 14 points to the method in Section 13.
